Are Jail Records Public in Alabama?

Yes. Jail records are public under Alabama law. Alabama Code Section 36-22-8 requires each sheriff to keep a book on all prisoners. The book must have names, ages, charges, and dates. Anyone can view it during office hours.

The Alabama Open Records Act in Section 36-12-40 also applies. State residents can inspect and copy public records. Jail rosters are public records. Viewing is free. Copies may have fees.

Some info stays private. Medical records are protected. Juvenile records are sealed under Section 12-15-133. Expunged records are removed per Section 15-27.

Bond Information

When someone is booked, a judge sets a bond. The bond amount depends on the charges. Paying the bond lets the person leave jail while waiting for court.

Alabama law requires a $35 fee for bonding out. This money order must be made out to "Circuit Clerk." This is separate from the bond itself. You pay this fee when posting bond.

You can use cash bond or a bail bondsman. Cash bonds need the full amount. A bondsman charges a fee, usually ten percent of the bond. That fee is not refunded. The jail staff cannot change bond amounts. Only a judge can do that.
